Terms and conditions of sale

1. Purpose
The purpose of these Terms and Conditions of Sale (hereinafter the "TCS") is to define the terms and conditions under which DIMAP provides its services to customers, together with the rights and obligations of the parties in that context.
2. Services offered
DIMAP offers services connecting designers, 3D printers and buyers, as well as 3D printing services and delivery of 3D-printed objects.
3. Prices and payment terms
Prices shown to the Customer are stated in euros, all taxes included.
The rates entered by the Seller on the Platform are exclusive of tax. Value added tax is added where applicable, according to the tax regime of the Seller: no tax is added where the Seller benefits from the small business exemption provided for in article 293 B of the French General Tax Code.
For each sale concluded on the Platform, DIMAP charges a commission equal to 20% of the price excluding VAT set by the Seller, plus any value added tax applicable to DIMAP. This commission is invoiced to the Customer in addition to the Seller's price.
The total price paid by the Customer comprises the price set by the Seller, the DIMAP Commission, delivery costs where applicable, and a service fee covering the processing of the Order. That service fee is the same regardless of the payment method used; its amount is shown to the Customer and included in the total price displayed before the Order is confirmed.
Payment is made by bank card when the order is confirmed.
Payments are collected by Stripe Payments Europe, Limited, a licensed payment service provider, on behalf of the Seller. DIMAP at no point collects or holds the sums paid by the Customer. Sums owed to the Seller are held in escrow by Stripe for seven (7) calendar days from receipt of the Product, then released under the conditions set out in the terms of use.
4. Orders
Any order placed on the Application constitutes a contract between the customer and the printer and/or 3D modeler involved, subject to the availability of the services.
5. Delivery
Delivery times are given as an indication only and depend on the chosen delivery provider. DIMAP may not be held liable for delivery delays arising from causes beyond its control.
6. Right of withdrawal and returns
Exclusion of the right of withdrawal (made-to-order goods): In accordance with Article L221-28 3° of the French Consumer Code, the right of withdrawal does not apply to contracts for the supply of goods made to the consumer's specifications or clearly personalised. As the Products offered on the DIMAP Platform are made to order according to a specification approved by the Customer, the right of withdrawal is excluded.
Non-conformity: If the delivered Product differs significantly from the agreed specification (colour, size, finish, material, obvious quality defect), the Customer submits a claim supported by photographic evidence. DIMAP issues a refund where non-conformity is established. A claim submitted within seven (7) calendar days of receipt suspends the payment of the sums to the Seller; after that period, it remains admissible and is handled on the same terms.
Statutory guarantees: That seven (7) day period in no way limits the Customer's rights, who benefits from the statutory guarantee of conformity for two (2) years from delivery of the Product (articles L.217-3 et seq. of the French Consumer Code) and from the statutory guarantee against hidden defects.
Change of mind: No refund will be granted to a Customer who changes their mind after confirming the Order, provided the delivered Product conforms to the agreed specification.
7. Warranties
Products sold on the Application are covered by the statutory warranties of conformity and against hidden defects.
8. Liability
DIMAP may not be held liable for failure to perform the contract in the event of force majeure, disruption, or total or partial strike affecting transport or communication services.
9. Intellectual property
The 3D models offered on the Application are protected by copyright. Reproducing or using them outside the scope defined by the licence of use is prohibited. The terms of the licence of use for 3D models are set out in the terms of use.
10. Licence of use for 3D models
Purchasing a 3D model grants the Customer a non-exclusive, non-transferable licence for strictly non-commercial use, with no limit on the number of prints. The Customer may print the model for personal use, give it as a gift, or use it for free merchandising purposes (goodies, gifts for employees or customers, stands). Reselling the printed objects and redistributing the file are strictly prohibited. The full terms are detailed in the terms of use.
11. Right of withdrawal for digital content
In accordance with Article L221-28 13° of the French Consumer Code, a Customer purchasing a 3D model (digital content supplied without a physical medium) expressly agrees, before downloading, that performance begins immediately and waives their right of withdrawal. Without that agreement, the download will not start.
12. Payments to 3D modelers
The 3D modeler receives the sale price they set for each direct file sale, less the DIMAP commission. When a model is used as part of a printing Order, the 3D modeler receives a royalty of 30% of the model price for each print produced.
13. Seller status and invoicing
The Seller's status, whether a private individual or a professional, the thresholds above which a SIREN number becomes mandatory and the invoicing mandate granted to DIMAP are set out in the terms of use, to which these terms and conditions of sale refer.
14. Personal data
The personal data provided by the Customer in connection with their Order is processed by DIMAP SAS, as data controller, for the purposes of creating and managing their account, processing their Order, payment, delivery, invoicing and customer service. That processing is based on performance of the contract and, as regards invoicing and tax obligations, on compliance with legal obligations.
The data is kept for as long as necessary for those purposes, then for the retention periods required by law, in particular in accounting and tax matters. It is disclosed only to the recipients necessary to perform the Order, in particular the Seller, the payment service provider and the carrier.
The Customer has the right to access, rectify, erase, restrict, object to and port their data, as well as the right to give instructions as to its fate after their death. These rights are exercised at contact@dimap.app. The Customer may also lodge a complaint with the French data protection authority (CNIL), 3 place de Fontenoy, TSA 80715, 75334 Paris Cedex 07.

15. Publisher and host

16. Governing law and jurisdiction
These TCS are governed by French law. In the event of a dispute, the French courts shall have sole jurisdiction.
